An Empire of Capital? Transatlantic Investment Protection as the Institutionalization of Unjustified Privilege

The field of investor state arbitration is historically connected to purposes and contexts, which are strikingly different from the contemporary world of trade and investment relations between liberal constitutional democracies. What might conceivably have been a mutually useful policy instrument in the relationship between developing and developed countries has no plausible role to play in the relationship between developed liberal constitutional democracies. The idea of investment arbitration as a field with its own separate dispute resolution infrastructure should be seen as an inherently dubious transitional phenomenon that deserves to wither away over time, rather than being reformed.

Why Armstrong is wrong and there IS in fact a legal duty to appoint Juncker

Thankfully the Treaties provide the basis for leaving behind the ancien régime of executive federalism and pushes towards a more democratic politics in Europe. Ironically the path to a brighter democratic future in Europe depends to a nontrivial extent on the Council acting in conformity with its duty to nominate a perhaps less than inspiring steady hand of the past as Commission President.

Why the Council is under a legal duty to propose Juncker as a Commission President

The German Chancellor has stated that she would “conduct all negotiations with a view to ensuring that Claude Juncker becomes President”. But the qualifications she continues to make suggest that she very much remains willing to hide behind Cameron and a minority of other leaders to aim for “a compromise” that will leave democratic aspirations in Europe severely harmed. Citizens have good reasons to be concerned.

„Eine parlamentarisch verantwortliche Regierung für Europa“

Wenn Sie an Europa im Jahr 2023 denken – woran denken Sie da? Es gibt drei Szenarien, glaube ich. In dem ersten Szenario sehe ich eine europäische Regierung, die nach hartem parlamentarischem Kampf und Versuchen, die Bevölkerung zu ihren Gunsten zu mobilisieren, erklärt, warum diese oder jene politische Entscheidung richtig war. Ich sehe ein Europa, in dem es so etwas wie eine europäische Regierung gibt, gestützt durch das Europäische Parlament, mit einer Zweiten Kammer, in der die nationalen Regierungen vertreten sind. Rettungsschirm für Grundrechte: Anmerkungen von MATTIAS KUMM

Ungarns Ministerpräsident Victor Orban und die von ihm kontrollierte Regierungspartei Fidesz sind seit der letzten Parlamentswahl 2010, bei der sie 53% der Wählerstimmen aber 68% der Sitze im Parlament auf sich vereinen konnten, dabei, das ungarische Verfassungssystem neu auszurichten. Dabei etabliert die Regierungspartei die Kontrolle über die Gerichte und das Justizsystem, die Medien und das Wahlsystem und erlässt zudem Regeln, die sicherstellen, dass auch bei veränderten Mehrheiten in der Zukunft die politischen Entscheidungen der Regierung nicht rückgängig gemacht werden können (Jan-Werner Müller und Kim Lane Scheppele haben dazu überzeugende Beschreibungen geliefert). Rescue Package for Fundamental Rights: Comments by MATTIAS KUMM

Hungarian Premier Victor Orban and his ruling party Fidesz, after having received 53% of the votes in the previous election but 68% of parliamentary seats, have transformed Hungarian institutions, effectively asserting and entrenching control over courts and the justice system, the media and the electoral system to align them with the interests of the ruling party (Jan-Werner Müller and Kim Lane Scheppele have provided compelling descriptions). This slide to authoritarianism should be a concern to constitutionalists, wherever it occurs, but it should be of special concern to EU citizens.
