Die Frage nach der Menschenwürde, und wofür sie gut ist

Dafür, dass die Menschenwürde der Haken sein soll, an dem zumindest bei uns in Deutschland die gesamte Grundrechtsordnung hängt, haben wir bemerkenswert ungenaue Vorstellungen darüber, was damit eigentlich gemeint ist. Um dem abzuhelfen hat „Recht im Kontext“ dieses Jahr erneut eine Runde von illustren Wissenschaftlerinnen und Wissenschaftlern um den Konferenztisch des Wissenschaftskollegs versammelt. The Constitutional Court remains true to itself providing, once again, the proper functioning of the constitutional powers. In a decision that – according to rumors that filter from Rome – was serene and without significant opposition among the judges, the »Consulta« has rejected the conflict of powers with which the Head of Government (which at that time was Silvio Berlusconi) lamented the lack of recognition by the court of Milan, of the „legitimate impediment“ opposed by the accused-President not to attend a hearing. Hans Joas wider den westlichen Menschenrechte-Triumphalismus

Wenn die Idee der Menschenrechte ein Kennzeichen der westlich-europäischen Kultur ist, Fluchtpunkt der christlich-jüdischen und humanistisch-aufklärerischen Stränge ihrer jahrtausendealten Geschichte – wie kann es dann sein, dass den größten Teil dieser Geschichte Sklaverei und Folter von Europäern legal und ohne großen Skandal praktiziert wurde? Diese Frage stand im Mittelpunkt der „Rechtskulturen Lecture“ des katholischen Sozialphilosophen und Ideenhistorikers Hans Joas, mit der die zweitägige Konferenz zum Begriff der Menschenwürde am Wissenschaftskolleg in Berlin heute Abend eingeleitet wurde. 1984, Hungarian Edition

The Hungarian parliament recently passed a new national security law that enables the inner circle of the government to spy on people who hold important public offices. Under this law, many government officials must »consent« to being observed in the most intrusive way (phones tapped, homes bugged, email read) for up to two full months each year, except that they won’t know which 60 days they are under surveillance. Perhaps they will imagine they are under surveillance all of the time. Perhaps that is the point. Transnationale Gerechtigkeit meets Global Constitutionalism

Am Montag hatte ich das Privileg, in Hamburg einen Roundtable zu moderieren, an dem Rainer Forst sowie vier der fünf Herausgeber der Zeitschrift Global Constitutionalism Platz genommen hatten. Es ging um Forsts Theorie transnationaler Gerechtigkeit im Kontext globaler Konstitutionalisierung. Die Diskussion mit Antje Wiener, James Tully, Anthony Lang und Mattias Kumm sowie vielen klugen Fragestellern im Publikum war sehr lebhaft und spannend. Transnational Justice meets Global Constitutionalism

Last monday I had the priviledge to moderate a roundtable discussion at Hamburg University among Rainer Forst and four of the five editors of the journal Global Constitutionalism - Antje Wiener, James Tully, Anthony Lang and Mattias Kumm - about Forst's theory of transnational justice in the context of global constitutionalism. Wie die rumänische Regierung die Verfassung „verbessern“ will

Letztes Jahr scheiterte der Versuch der rumänischen Regierungskoalition, den Präsidenten per Referendum zu stürzen, an zu niedriger Wahlbeteiligung und am Widerstand des Verfassungsgerichts. Jetzt bereitet sie einen zweiten Anlauf vor - und will dabei die Verfassung ihren Plänen anpassen. Ein Parlamentsausschuss hat entsprechende Änderungen beschlossen - unter dem Vorsitz von niemand anderem als dem Präsidentschaftskandidaten der Koalition.

How the Romanian government wants to „improve“ the Constitution

Last year the Romanian governing coalition failed to unseat the President in a referendum because of a too low voter turn-out and the resistance of the Constitutional Court. Now it prepares for a second attempt and aims to customize the constitution to that end. Accordingly, a Parliamentary Committee has adopted several changes - chaired by no other than its own Presidential candidate.
