Jetzt hat sich unser Erkenntnisstand insofern vermehrt, als wir wissen, dass der BUNDESTAG zustimmen muss, wenn das Geld der Deutschen verliehen oder ausgegeben wird. Die Bundesregierung hatte nach dem Urteil vom September geglaubt, die geforderte Beteiligung des Parlaments an der Euro-Rettung lasse sich auch dadurch herstellen, dass neun handverlesene Mitglieder des Bundestags dieses Recht anstelle ihrer 620 Kolleginnen und Kollegen ausüben, auf dass nicht am Ende die Parlamentsbeteiligung zu etwas ausarte, was sich der Kontrolle der Regierung entzieht. It is a tribute to the thoughtfulness of the Heidelberg proposal that it has stimulated such a provocative exchange of views so far. It is quite obvious that, regardless of one’s position vis-à-vis the merits of ›reverse Solange‹, there is widely shared concern regarding the evolution of the Hungarian regime. Rettungsschirm für Grundrechte: Anmerkungen von DANIEL THYM

Die Parallelen zwischen den Notoperationen zur Euro-Rettung und einer EuGH-Grundrechtsintervention in Ungarn sind bemerkenswert: In beiden Fällen zeigen sich Konstruktionsschwächen der EU-Verträge, und die Befürworter von »mehr Europa« fordern eine Stärkung der überstaatlichen Aufsichts- und Kontrollrechte. Diese Rückkehr zur Integrationsmethode der 1970er-Jahre ist nicht frei von Risiken. Defizite der EU-Verträge liegen auf der Hand. Bei der Schaffung des Euro wurde auf eine Wirtschaftspolitik verzichtet und auch die EU-Grundrechte sind von einer Asymmetrie geprägt. Playing With Matches: The Czech Constitutional Court’s Ultra Vires Revolution

By JAN KOMAREK When the Czech Constitutional Court (CCC) declared the CJEU’s judgment in C-399/09 Landtová »ultra vires«, one of my colleagues commented: »giving Solange into their hands was like to let children play with matches«. Schafft den Bundespräsidenten ab!

Soeben ist Bundespräsident Wulff zurückgetreten, und da ist es Zeit für eine Bitte: schafft das Amt ab! Warum? Weil es ebenso überflüssig wie gefährlich ist, ein dummer Anachronismus und hochnotpeinlich schon in guten Zeiten. Peinlich ist mir der Bundespräsident immer schon gewesen. Wenn er im Fernsehen auftrat (wer schaut da eigentlich heute noch hin?) schaltete ich ab oder verließ den Raum. Wie da jemand so unbedingt der bessere Mensch sein musste, mit den Anständigen paktieren und auf die böse Politik oder die faulen Deutschen (Ein Ruck, zwei-drei) schimpfen musste, peinlich!
