Bricolage, Bullshit, and Bustle

On 15 December 2023, the Swiss Federal Council (Government) announced that it intended to start formal negotiations with the EU on the conclusion of a Framework Agreement (FA) 2.0. Five existing and two new treaties between the EU and Switzerland are to be subject to dynamic alignment and institutionalised, i.e. provided with a monitoring and judicial mechanism. The project, which is practically fixed in the decisive questions by a “Common Understanding” (“CU”) between the two parties, is based on a triple B approach: in substance, it consists of unsuccessful bricolage, the foundations were laid by bullshit, and because elections and a change of the Commission are imminent in the EU, bustle is supposedly of the essence. The CU summarizes what the Parties have informally agreed on.

Civil Disobedience on Trial in Switzerland

Since 2018, Swiss courts have become regular sites of criminal trials against climate activists who engage in various forms of non-violent protest to obtain effective climate action from their government and raise public awareness. Since the autumn of 2018, we have recorded approximately 30 non-violent forms of climate protest and civil disobedience across Switzerland, leading to at least 200 trials in Swiss criminal courts. In this contribution, we highlight three themes that have emerged in the trials of climate activists: First, the Federal Supreme Court has closed the door to the use of the necessity defense to justify civil disobedience in the name of the climate emergency. Second, at least some Swiss judges and courts are open to considering and applying the case law of the ECtHR. Third, the idea of civil disobedience remains deeply contested in the courts, as it is considered by the authorities to be antithetical to the Swiss model of democracy.

Function Follows Form

Die Idee, dass die Form eines Artefaktes nach dessen Funktion gestaltet werden müsse, ist seit dem Ende des 19. Jahrhunderts eine zentrale Design-Maxime: Form follows function. Wo die Formen sich aber verändern, zum Beispiel, weil sich ein Produkt neu in digitaler Form erstellen lässt, muss die Frage erlaubt sein, ob es nicht noch andere als seine bisherigen Funktionen erfüllen kann. Menschen sind aber besser darin, aus der Funktion Formen abzuleiten, als aus Formen Funktionen. Daher lohnt es sich, die Frage nach alternativen Funktionen ganz gezielt zu stellen. Wir wollen das nachfolgend für das Produkt der rechtswissenschaftlichen Kommentare tun.

Democratizing Switzerland

Bei der Suche nach Antworten auf diese Probleme wird man schnell auf den Dreh- und Angelpunkt der ganzen Operation stossen: Die bundesrätliche «CS-Notverordnung»? Dass Fragen dieser Tragweite durch exekutive ad-hoc Beschlüsse und nicht durch im vornherein klar in formellen Gesetzen etablierten Prinzipien beantwortet werden, wirft tiefgreifende Probleme bezüglich der Vereinbarung dieser Notrechtsbestimmungen mit der Gewaltentrennung und der Rechtsstaatlichkeit auf.

Migrant Workers and the 2022 FIFA World Cup in Qatar

When we are enjoying the beautiful game these days, we should not forget that hundreds or even thousands of migrant workers, mostly from Bangladesh, India, Nepal, Pakistan, Philippines and Sri Lanka have allegedly lost their lives in Qatar when working on stadium and other infrastructure constructions in view of the 2022 FIFA World Cup. FIFA as the overarching, but private international football governing body in charge of the organization of the World Cup is not, as such, liable under the ECHR neither. It has, however, its headquarters in Switzerland. Is this enough to hold Switzerland, a party to the ECHR, liable for human rights violations in Strasbourg?

Direct Democracy or Climate Litigation?

The Klimaseniorinnen case has gained worldwide attention since the announcement of the relinquishment in favour of the Grand Chamber. The case is one of many strategic proceedings initiated around the world to sanction inaction or insufficient action by states on climate issues. While the Swiss government claims that the Swiss political system, with its democratic instruments, offers sufficient possibilities for the consideration of such claims, this blog post argues that the Swiss right to initiative alone is not sufficiently effective and therefore not an alternative to legal proceedings.

Climate Change Litigation Before the ECtHR

Verein KlimaSeniorinnen Schweiz and Others v. Switzerland is the first case of climate change litigation before the ECtHR where all domestic remedies have been exhausted. The Chamber to which the case had been allocated relinquished jurisdiction in favour of the Grand Chamber. This reinforces the potential of the case to become a landmark ruling determining the Court’s approach to climate change.

Flexible Neutralität

Die Schweiz hat die Sanktionen, welche die EU als Antwort auf die Aggression Russlands gegenüber der Ukraine verhängt hat, spät aber umfassend übernommen. Die Einordnung dieses vollständigen Schulterschlusses der Schweiz mit der EU ließ in der Presse nicht lange auf sich warten – noch gleichentags titelte die New York Times „Switzerland says it will freeze Russian asstes, setting aside a tradition of neutrality“. Doch so drastisch ist der Schritt der Schweiz gar nicht, er tangiert weder ihren neutralitätsrechtlichen Status, noch steht zum jetzigen Zeitpunkt fest, dass er eine generelle Neuausrichtung der Schweizer Neutralitätspolitik einleitet.
