On the State of Academia in India

The Economics Department at India’s Ashoka University received an unexpected visit from the Federal Intelligence Bureau. The reason for this visit was a paper titled ‘Democratic Backsliding in the World’s Largest Democracy’ by Sabyasachi Das, an economist. In his research, Das meticulously examined 11 contested seats during India’s 2019 general elections and uncovered imbalanced outcomes that favored the ruling party, BJP. Das noted that ‘the results point to strategic and targeted electoral discrimination against Muslims, in the form of deletion of names from voter lists and suppression of their votes during election, in part facilitated by weak monitoring by election observers.’ The subsequent visit by the Federal Intelligence Bureau is just one among several incidents that highlight the precarious state of academic freedom in India.

The Council’s Conditionality Decision as a Violation of Academic Freedom?

On 15 December 2022, the Council’s suspended various EU budgetary commitments towards Hungary, the first application of the so-called Rule of Law Conditionality Regulation. The measure also froze access to Erasmus+ and Horizon Europe funds for 21 Hungarian universities that remain under the management of public interest trusts, thereby effectively denying access to these funds to a large pool of scholars and students. The decision raises important questions regarding the scope of protection afforded to final beneficiaries of EU funds. We suggest that a deeper engagement with the rights and interests of final beneficiaries in the context of the Conditionality Regulation necessitates a reconceptualisation of the EU’s understanding of and responsibility for academic freedom.

Wehrhafte Hochschulen und Wissenschaftsfreiheit

Hochschulen sind keine Arena für den politischen Meinungskampf, sie sind Orte wissenschaftlicher Forschung und Lehre. Sie werden gerade als institutionelle Ankerplätze für eine vorpolitische Rationalität benötigt und müssen glaubwürdig Distanz zu allgemeinpolitischen Auseinandersetzungen halten. Um die Integrität der und das Vertrauen in die Wissenschaft zu sichern, müssen sich Hochschulen dann auch gegen diejenigen wehren, die ihre epistemische Amtsautorität missbrauchen und mit dem Anschein von Wissenschaft Falschbehauptungen, unhaltbare Spekulationen oder krude Verschwörungstheorien verbreiten. Die Hochschulen sind es der Glaubwürdigkeit von Wissenschaft schuldig.

Die unklare Zukunft der Wissenschaftstransparenz

Müssen Wissenschaftler ihre Ergebnisse frei zugänglich machen? Unter diesem Titel wurde vor fünf Jahren über ein Normenkontrollverfahren in Baden-Württemberg berichtet, auf das damals die deutsche Wissenschaft mit Spannung wartete. Das Interesse an der Frage ist ungebrochen, betrifft sie doch den Kernbereich der Wissenschaftsfreiheit. Nicht umsonst beschäftigt er seit September 2017 auch das Bundesverfassungsgericht, dem das Verfahren zur Entscheidung einer Vorfrage vorgelegt wurde. Bald jährt sich die Vorlage zum fünften Mal. Was seither geschah? Nichts.

Threats to Academic Freedom under the Guise of Open Access

The Budapest Open Access Initiative is celebrating its 20th anniversary and today it seems that we are closer than ever to finally concluding the “access revolution” predicted by many since the arrival of the internet. Yet, developments in the publishing system increasingly suggest that the access revolution is much less revolutionary than expected. Reports gradually bring to light the extent to which publishers started to use the data tracking tools developed by “pioneers” such as Google and Facebook. This development could not only be the final blow for the Open Access movement’s potential to more radically and structurally change the way knowledge is being disseminated in the digital age but pose a systematic threat to the autonomy of the science system and academic freedom in the digital age.

Constitutional Democracy and The Sound of (Academic) Silence

Many constitutions, and the liberal values that permeate them, constitute the reaction to the mass atrocities, often in the face of academic silence (if not full-blown endorsement). Therefore, a constitutional law scholar that does not denounce attempts to subvert the constitutional order as such is actually sacrificing the pursuit of legal knowledge at the altar of a misguided – and historically damned – attempt at ‘neutrality’. The sound of academic silence, in the face of constitutional regression, is deafening.
