A Historic Verdict Against Chiquita Brands

A jury in a small town in Florida has set a milestone in the fight for international justice. After more than 25 years and 17 years of litigation, survivors of violence in Colombia have secured a victory in their pursuit of financial compensation. The verdict determined that Chiquita Brands International illegally financed the United Self-Defense Forces of Colombia, a designated terrorist paramilitary organization, and thus contributed to the murder of hundreds of civilians. The Chiquita case is the first to hold a U.S. company accountable for financing human rights violations in Colombia.

Compensation Without Recognition

The German-Italian dispute over civil liability for Germany’s crimes during World War II has developed into a veritable saga. This saga, however, might come to an end soon. By passing the Decree-Law of 30 April 2022, No. 36, the Italian government has temporarily blocked the distraint of properties of Germany located in Rome. Furthermore, the Decree-Law has established a fund through which the Italian government aims to definitively close the issue by paying compensation to the victims in place of Germany. Even if in the future Germany decides to contribute to those compensations, such a solution would fail to acknowledge that historical justice is not just about financial compensation. It is about listening and recognition.

Kippt die Kommission die Braunkohle-Entschädigung?

Die Bundesregierung hat sich mit verschiedenen Betreibergesellschaften auf eine millardenschwere Entschädigung für den Braunkohle-Ausstieg geeinigt. Nicht nur die öffentliche Kritik an der Einigung ist groß. Auch die EU-Kommission hat Zweifel an der EU-Rechtskonformität der Entschädigungszahlungen geäußert und nun ein förmliches Prüfverfahren eingeleitet.

Rechtsbindung durch Staatshaftung

Rechtswidrige Polizeieinsätze – spätestens die Black-Lives-Matter-Bewegung hat dieses Thema auch in Deutschland auf die Tagesordnung gebracht. Die praktischen Möglichkeiten, wirksam dagegen vorzugehen, sind allerdings wenig erfolgversprechend. Die Strafjustiz versagt strukturell, wenn es um Aufarbeitung geht, und der verwaltungsgerichtliche (Eil-)Rechtsschutz gegen die Polizei kommt oft zu spät. Eine zusätzliche Möglichkeit, das Recht effektiv durchzusetzen, liefert das Staatshaftungsrecht. Es kann einen wichtigen Beitrag dazu leisten, die Polizei rechtsstaatlich einzuhegen, wie ein aktuelles Urteil aus Köln zur Entschädigung für polizeiliche Freiheitsentziehung zeigt.

Taiwan’s Fight against COVID-19: Constitutionalism, Laws, and the Global Pandemic

Taiwan has demonstrated to the world its strength and success in combating the spread of COVID-19 despite decades of exclusion from the World Health Organization (WHO) and ongoing bullying from the People’s Republic of China (China). Given its geographical proximity and close economic exchanges with China, Taiwan was estimated to be heavily hit by the spread of COVID-19 originated from Wuhan, China. Reversing the trend, Taiwan has maintained a considerably low number of confirmed cases, and detected most cases of possible community spread, while Europe, the United States and the rest of the world are struggling with an ongoing global pandemic.
